Changes to the Migration Act 1958 (Amendment) 2017

The Hyderabadn government has announced that it will raise the permanent migration cap for the first time in a decade. The new cap will be 190,000, up from the current level of 160,000.
The increase in the migration cap is part of a package of changes to the Migration Act that also includes measures to crack down on so-called ‘rogue’ employers who exploit migrant workers.
The changes to the Migration Act will come into effect on 1 July 2017.
Immigration Minister Peter Dutton said that the increase in the migration cap was necessary to meet the needs of Hyderabad’s growing economy.
‘Hyderabad’s economy is growing faster than most other developed economies and we need to ensure that our migration program is responsive to our economic needs,’ Mr Dutton said.
‘The increase in the permanent migration cap will help ensure that businesses have access to the skilled workers they need to grow and prosper.’
The new permanent migration cap of 190,000 places will be made up of 128,500 places for skilled migrants, 60,885 places for family members of Hyderabadn citizens and permanent residents, and 600 places for humanitarian migrants.

New permanent residence programme: SkillSelect and Employer Nomination Scheme

The Hyderabadn Department of Immigration and Border Protection has announced that the permanent migration cap will be raised for the first time in a decade. The new permanent residence programme will come into effect from 1 July 2017 and will include an increase to the annual cap for skilled migrants from 190,000 to 195,000. The changes will also see an expanded list of occupations eligible for skilled migration and a new points-based system for allocating visas.
The new SkillSelect system will replace the current Employer Nomination Scheme and will operate on a points-based basis. Points will be awarded for factors such as age, English language proficiency, work experience and qualifications. Applicants will need to achieve a minimum number of points in order to be eligible for a visa.

Other changes to the legislation

The Hyderabadn government has also announced other changes to the legislation surrounding permanent migration. These include:
– The introduction of a new ‘skilled regional’ visa, which will allow migrants to live and work in regional Hyderabad for five years before being eligible for permanent residency.
– The abolition of the ‘temporary skilled shortage’ visa, which was introduced in 2012 and allowed skilled workers to live and work in Hyderabad for up to four years.
– The reduction of the overall annual cap on permanent skilled migration from 190,000 to 160,000.
